IMPROVEMENTS IN FREE TRADE ZONE REGIME FOR LOGISTIC SERVICES COMPANIES IN COSTA RICA

On September 10th, 2018, Executive Decree No. 41263-COMEX-H was published in the Official Government Journal “La Gaceta” No. 158.  This Executive Decree amends and adds several sections of the Regulations of the Free Trade Zones Regime Law, specifically regarding the logistic services companies’ legal framework, in order to strengthen, clarify and enhance such legislation by incorporating clear, coherent and simple rules and implementing intelligent and practical controls to attract the establishment of logistic services companies (SEL) in the free trade zone regime in Costa Rica by making their operation competitive, efficient and cost effective.

In general terms, the Executive Decree amends the Regulations as follows:

  • It includes the definition of key terms for this type of operation.
  • It clearly outlines the activities that can be performed by a SEL, as well as the requirements and obligations that shall be met.
  • It simplifies the provision of logistic services.
  • It identifies all the potential clients the SEL could have.

It clarifies and regulates specific operation difficulties that the current SELs were having, like the sales to local market, transportation of goods, inventories among others.

These changes provide excellent opportunities for this type of operations in Costa Rica and a very attractive tax exemption regime.
